Home care agency licensing and compliance guide

Home care agency licensing and compliance begin with the care your caregivers deliver, not a borrowed checklist. Build the authority map, then test it.

What to take away

  • Licensing splits into four independent tracks: the business entity, the caregiver credential, the service site, and the regulated activity. One approval never covers another.
  • California licenses Home Care Organizations through its Department of Social Services. New York licenses Licensed Home Care Services Agencies through its Department of Health. Texas licenses Home and Community Support Services Agencies through HHSC.
  • Federal rules sit on top of the state licenceMedicare certification for skilled home health, travel-time pay, and client privacy.
  • Typical state licence review runs 60 to 180 days, and application fees typically fall between $500 and $5,000. Confirm the current schedule with the licensing unit.

Scope of practice, classification and funding rules vary by state, province and payer. Confirm each requirement with the body that sets it.

The four approval tracks, named

TrackTypical instrumentIssuing body
EntityLLC or corporation registration, trade name, EIN, state tax accountSecretary of State, IRS, state revenue department

SiteZoning or occupancy approval, fire clearance, accessibilityCity or county zoning office, fire marshal
ActivityHome care licence, home health licence, Medicaid provider agreementState health or social services department, state Medicaid agency

Check each column against every worker and every address. A registered company with an unregistered aide is not compliant, and neither is the reverse.

The quality assurance checklist lists the files a surveyor asks for and the ones most agencies cannot produce.

How to file: order, fees and timelines

  1. Register the entity with the Secretary of State and get an EIN from the IRS.
  2. Decide whether your tasks trigger a licence. Hands-on personal care usually does. Homemaker and companion work sometimes does not.
  3. File with the named regulator, with fingerprints, background checks and proof of liability insurance.
  4. Apply for a Medicaid provider agreement, plus Medicare certification for skilled nursing.
  5. Open withholding, unemployment and workers' compensation accounts.
  6. Clear zoning and fire approval for the office before you sign the lease.

Initial licence fees typically land between $500 and $5,000, with renewals lower. Reviews commonly take 60 to 180 days, and fingerprint checks add two to six weeks. These are typical ranges, so confirm current figures with the licensing unit.

Adding personal care later repeats steps two to four. The service line expansion guide covers how to test demand and supervision capacity before you file.

Example: California beside Ontario

California requires a Home Care Organization licence from the Department of Social Services before an agency may offer hands-on personal care. Skilled nursing visits need a separate Home Health Agency licence from the Department of Public Health.

Ontario requires neither. A private agency may operate without a provincial licence, and personal support workers are not a regulated health profession. Controlled acts need a regulated professional or a documented delegation.

What each caregiver role may do

RolePermittedNot permitted
CompanionCompanionship, light housekeeping, meals, errands, remindersHands-on personal care, transfers, medication administration
Personal care aideBathing, dressing, toileting, feeding, transfers under a written care planSkilled nursing tasks, medication administration without written delegation
Home health aideThe duties above plus tasks a registered nurse delegates and supervisesIndependent clinical judgment
RN or LPNAssessment, medication administration, delegation, supervisionAnything outside the state scope of practice

Delegation is the trap. A task one state lets a nurse delegate may be banned next door. Name the delegating professional, record the delegation and set an expiry date.

Verifying a credential or registry listing

  • Search the state nurse aide registry by name and certificate number.
  • Verify RN and LPN licences through Nursys or the state board of nursing.
  • Confirm aide training with the school or the state's approved list.
  • Screen against the HHS OIG exclusion list and the state Medicaid exclusion list before hire, then monthly.
  • Rerun the criminal background check on the state's schedule, not yours.

When a check returns a gap, the hiring and training guide covers how to document the decision either way.

Pay, records and privacy duties

Travel between clients in one day is usually compensable. The Department of Labor's fact sheet on hours worked in domestic service sets out on-duty, waiting and job-to-job travel rules with home care examples.

Employee or contractor is a legal question, not a scheduling preference. The IRS common-law test turns on control over hours, tools and how the work is done. In Canada, payroll withholding and provincial workers' compensation premiums apply to employees.

Client health information is the most sensitive data you hold. The HIPAA privacy rule governs how you collect, store and release it. Give each staff member an individual account.

Every service agreement should state scope, hourly rate, cancellation terms, who supplies materials, what happens when a shift is unfilled, and how complaints escalate. Keep the version in force on the date of service.

Mileage between clients, unpaid travel and the gap between scheduled and worked hours quietly destroy margin. The operations and workflow guide shows where those numbers hide.

Common questions

Does a business licence cover my caregivers?
No. Entity registration, caregiver credentials and activity authorization are separate approvals. An aide working without the required listing puts the agency at risk.
Can a personal care aide give medication?
Only if your state allows it and a regulated professional has delegated the task in writing. Ask the delegating nurse, not another agency's job posting.
How often should the compliance map be reviewed?
Monthly while a process is new, then on a fixed schedule. Reopen it when services, locations, payers, staffing or ownership change.
Do I need a licence in every state I serve?
Yes. A licence, Medicaid provider agreement and background check clearance from one state do not transfer to another, and each state's regulator runs its own application.
